I am receiving calls from Mr Gross. How did your case play out? I am getting numerous calls daily. I have asked for proof and they will not send.
Thank you all for your comments. I'm a Credit Manager for a large company. I received a voice mail message from this company wanting to do our collections. That was a month ago. Since then they called almost every day without leaving a massage. They are a collection agency, but obviously not one that follows the Fair Debt Collection Practices Act. For consumer collections an agency must provide written proof of debt. They cannot call again until they do. If they do call, it's another violation. If they continue to annoy, google the act and know your right...then have fun with them.We use collection agencies. However, this type of agency would reflect poorly on my company if I used them.
I'm confused, they called you wanting to do collections work for you, but you are citing the FDCPA? If they are calling to solicit your business, where would any proof of debt come into play? By the way, the FDCPA does not apply to commercial accounts. It was created to protect consumers. It sounds like there is a commercial debt involved (since there is a credit manager and you use collection agencies) to which they are pursing collection on. Ignoring a past due debt and "having fun with it" is certainly not the best advise.
Our firm received a phone call from this " company " who then proceeded to inform us that they are a law firm. Mr. Jessie Niven is who he stated to be. Whether that is his legal name or not we do not know. He insisted on speaking with the person who runs our financial department. We are a Tax/ Business/ Estate Law Firm. When asked for documentation, he would not provide any in any form. Sounds like smells like acts like...A SCAM
Peter called, left a VM stating that CenturyLink would "proceed" legally if we didn't respond. TO WHAT??? Saying we owe $7,800+. Once I emailed him, he doesn't have an account #, no contracts, etc.. BEWARE! I smell a BIG SCAMMER!!!

So what if you are a member in good standing with the NJ Bar. People are complaining about what they consider fraudulent debt collection attempts from calls coming in with your telephone number in the Caller ID, or your business name is the name given by the caller.Perhaps you want people to record the calls they get from your debt collection business so they can prove to you that YOU have problem employees ? You and your employees better assume your calls might be recorded by the recipients of your calls, because technology makes it trivial to do so. The Court of Public Opinion doesn't consider recording calls from clods to be illegal.
To all reading this: Many "law firms" in N.J. and America are really just collection agencies who have been purchased by bigger companies to retrieve money from people or corporations. They're {MOSTLY} not actual law firms. You are not in legal risk, and with this law firm, the N.J. branch will just have collections agents call you & harass you. There is no legal anything behind it. There's no lawyers, there's no civil cases, there's no backing to their threats. They're just hired guns who talk a big game. Don't believe some garbage posting that some b.s. 'law firm' copies & pastes repeatedly so you'll be fooled into thinking that they're legitimate.
