If you really work for Zwicker, your message may violate the Fair Debt Collection Practices Act
Just got their calls starting yesterday. I have no money either and no job. I just read up on this stuff and yeah, I sent the cease and dissist letter and the debt validation letter, hopefully if that will buy me some time. If they take me to court and get a judgment I don't see what good it will do them if I cant pay. If I could pay my bills I would be paying them. but it's like they want all the money now all of the sudden. The credit card company should of known better before they gave me so much credit. I really didn't deserve to have any credit cards in the first place. Maybe if they made the rules a little stricter it wouldn't allow irresponsible people like me having money in my hands to play around with. If worse comes to worse I will have to find a way to file bankruptcy and pay the lawyer. I don't know how much that will cost but I'd rather pay 1 thousand and clear all my debts then pay back 5thousand which I don't have.
Just a quick comment or two: Most people think Collections people like you are scumbags, not because you are there to collect money, but because of your behavior on the telephone. That is why you get to make 250 phone calls a day that are not answered. You have trained us to avoid you.People DO have an obligation (including me) to pay back money borrowed, regardless of the rate. If you don't like the rate, don't borrow there.I owe almost a million dollars, borrowed for business. Business dropped 90%, and I am on the hook. I have had hundreds of telephone calls. Here is what I have learned:You will do nothing but waste your time talking to the likes of Michelle. Stay off the phone. Being nice won't help. You will very likely get a letter (eventually) offering to vastly lower the interest rate, or even pay principle only. Those opportunities are worth looking into. Remember, EVERYTHING is negotiable, even if there is a judgment against you. If they believe that there is not much to collect, they will get VERY flexible.I settled a $5000 judgment for $1,000. To reinforce your negotiating position, lease, don't buy, your car. Put your house in your wife's name (if her credit is still good). Put large assets into a Trust. Establish credit separately from her. Bankruptcy is worth considering generally for large sums only. You would be foolish to do it for $2500.IRA type assets are protected. Do the best you can, and they to get them to accept smaller payments for a while, without crushing your credit. They will not likely go to court for $200. But you can bet they will for $20,000. I will discharge 100% of debt with a bankruptcy, mainly because it was all for business, even though it involved personal credit cards. After bankruptcy, you will get lots of credit card offers from the same people. the most important thing to remember is to NEGOTIATE everything. Make low offers (i.e.$1,000 on $5000 judgment). Try to do the right thing, but if you just can't, then play the game by the rules, and only do what works.PS Just got my first call from Zwicker. I didn't answer it. I wonder if it was Michelle? Michelle,Don't sweat these people. Maybe they aren't all scumbags for not paying their bills, but they are scumbags for jumping all over you in an online message board.I love how everyone that gets "harassed by Zwicker" are never at fault. It's always the economy, their boss's fault, etc. Bottom line, debtors - you signed an agree to pay with the original creditor. You defaulted on that agreement with your creditor. We at Z&A are now handling the account and the debt (per the agreement you signed!) is due in full. In most cases we work with debtors to settle and make payments - do you realize we don't have to do that????In most cases, Z&A is the second or third party to call about the debt! Times are tough, but it's not like you missed one payment or were late one day. The accounts are usually six months behind. Be accountable for your actions and handle your business and Z&A won't "harass" you.
No you're wrong. Yes you can get them removed all day but in 30 days when the credit bureau or the company verifies the bad debt it can be added back on. FYI
I received a phone all from this number - they were very impolite and would not even identify themselves.We have A+ credit and have no reason to hear from them. Go figure ------
Well let me tell you all...These people don't play around...They are withholding earnings from my paycheck and they also put a lien on my bank account...This is my story:I been fighting with these people back and fourth for almost a year now...I have a student loan with US Funds (Sallie Mae)...At the beginning we did made a verbal agreement over the phone to start a payment plan...The gentleman I had spoken with, was nice and we set up a payment plan…After I made 3 payments I did not see the money being credit to my student loan account...So I decided to stop payment, till I got a written contract from them...I also written to Sallie Mae on my situation and they written back stated that my account was transfer over to US Funds...I have written to US Funds couple of times and yet to hear from them...I also have written to Zwicker & Associates to send me the contract we agree on and also haven't heard from them...I got no phone calls and no letters…Then out of the blue, I get a letter from my employer stating that they will be withholding earnings from my paycheck …I then went to check my back account and that also had a lien on it...I guess they didn't want to put up a fight with me, so they decided to take this route instead...I had read everyone posted and a lot of you went threw some nightmares with these folks and hope that everything will turn out alright for all of you…Well for me, I know this will hurt me for a very long time but overall, at least I can get my student loan paid off…I know Our Heavenly Father will help me get threw this, like all the other blessing he have given me…I just wanted to share my story….DG…
