Debt collectors are exempt from the DO NOT CALL rules. However, you can still file complaints with regards to their conduct, especially if they are flat out harassing you. You can also send a certified letter to them telling them not to call your numbers. THEN, you can nail then for continued calls.
Tell them you want their refusal of the $50 a month you offered in writing. In some states, if they refuse to take payment, you can contact your Attorney General's Office, and they will investigate. If true, they will force the collections agency to zero out the bill owed. The original entity won't be able to bill you the amount after that either. They'll have to sue the collections agency for the money they caused them to lose.If they refuse to put their refusal in writing, them send them a certified letter (with the return confirmation that they received it), and tell them that due to very limited funds (I'm on disability too. It doesn't pay squat. ), you are only able to pay them $50 a month and will do so from this point forward. Stick a $50 check in there as a show off good faith. In the same letter, tell them they are not to call you or anyone else, with the exception of whom the bill is owed (hospital, doctor, whatever) staying on the date they signed for this certified letter. They are only allowed to contact you through written communication from this point forward. File complaints anyway, and send them copies of your complaints. That'll rile them up! Lol
Debt collectors are exempt from the DO Not Call list as they are not trying to sell you anything, but are trying to collect money owed. The DNC protects you from telemarketers and harassing phone calls (for example) from DirecTV, trying to get your service back because you went to DISH. However, you can and should send a certified letter with return receipt stating that they cannot call anyone (except for the entity owed) from the date they signed for the letter, and that you will only allow written communication from this point forward. If they continue to call you, your family, your friends, your employer, etc., write down the date and times and report them to you state's Attorney General's Office. It is a $1,000 fine, payable to you, for EACH offense. Good luck!
Just so everyone who posts here knows: being on the Do Not Call list will not, I repeat, NOT keep a debt collector from calling you. Debt collectors are EXEMPT from the DNC rules, as they are not trying to sell you anything; they are trying to collect money for services already rendered. However, you can stop them from calling you, your employer, your family, your friends, that weird guy who lives next door, your pastor. .. You get the idea. Simply send them a certified letter, with return receipt telling you who signed for the letter and the date it was received. In the letter, state that they cannot call you or anyone else, with the exemption of to whom the bill is owed (hospital, doctor, whatever), from the date they signed for the letter onward. Tell them that they are required to contact you through written communication only (give them the address to send letters to or an email address), and that they are to fully disclose all information regarding the debt allegedly owed, including but not limited to: the dates of service, to whom the services were rendered, how much your insurance covered, how much you allegedly owe, and to whom the bill is owed (hospital, doctor, whatever). Collection agencies are notorious for sending letters only giving the amount owed, and that's it. Personally, I'm not paying them one penny until I have all of the information regarding the debt(s), so that I can verify it. I have run in to too many instances over the years of having already paid the debt to my doctor or whatever, then either they forgot to tell the collections agency that it's paid, or I paid right after they sent it to the collections agency, and they hadn't sent me a threatening letter yet. You have to be careful and not double pay, because trust me, the collections agency won't tell you, and after finding out you already paid the bill to whomever it was owed, they still won't tell you. How screwed up is that? Last, but not least, send a copy of the letter, and a copy of the return receipt showing who signed for the letter and the date it was signed, to your state's Attorney General's Office. Now to the awesome part, woot! Write down the dates, times, and who they called (write down the phone numbers) starting from the date they signed for the letter. Report them to your Attorney General's Office in writing, and be sure to include another copy of the letter you sent to the collections agency, and a copy of the return receipt showing who signed for it and the date it was signed. They will fine the collections agency for EACH offense to the tune of $1,000 a call! And guess what? YOU get all of the money!!!! Pretty awesome, right? Hope this helps!Oh and one other thing. After getting the information requested, call whomever is owed and see if you can set up payment arrangements or pay the bill in full to them, not the collections agency, and ask them to take it back from the collections agency so that they will stop harassing you. I've had a lot of success with this approach. My daughter and I have a lot of serious medical issues, and I simply cannot pay everyone, in full, all at once. The order of payments for us goes family physicians and/or pediatrician, specialists, hospitals, and miscellaneous. It can be frustrating to be harassed daily. Nothing like getting woke up by a debt collector at 8:00 am on a Sunday. Good luck!
This company keeps calling my phone and they don't tell me who they are they are wanting to speak to someone that I have never heard of. I would like them to stop calling me please
