Been getting calls from Midland for about two months now trying to collect on a bogus debt. When I asked how they got my information they said that it was bought from the bank I sup possibly owe money to. I then asked for contact information so I can turn the information over to my attorney. The caller hung up and they have quit calling.
Marty, I'm assuming you gave your child a cell phone (please tell me its for emergencies only, 12 year olds do not need their own phones). If so, you can add a call blocker app and blacklist the number that keeps calling. Or if your 12 year old is mature enough, let them have some fun with the caller just make sure they never give out any REAL info.
I'm not even old enough to have a credit card, but they are still calling me. This is the second number midland has used to spam call me and I'm [***] tired of it.
I canceled my contract with T-Mobile for my phone and my three kids's phones when our contract was up. My second oldest daughter decided to keep her phone with them but the other two kids and myself, switched to Verizon. I spoke to T-Mobile myself to cancel the contract (It was the day the contract expired and I was not renewing) and my daughter (In another state) was in a T-Mobile office at the same time getting the contract for one phone and the number switched to just her. The rep in my state was on the phone with the rep in her state at the same time getting this taken care of.Well 8 months later....seriously....8 months!! I get a bill from them for over 800.00!I called them immediately and asked them what the heck was going on. They told me that I was supposed to have paid a cancelation fee for my out of state daughters phone and this was the charge - plus late fees! I told them how our contract was up on all four phones and three of us went to Verizon and one stayed with T-Mobile and there was NO cancelation fee...but they wouldn't listen to me, even when I sent them the paperwork from the day it was all supposedly taken care of. Now they are up to over 1200.00 and I am not going to pay a penny of it! I paid the account off fully the day our contract was up and my daughter in the other state kept her separate contract up until it expired then she switched to Verizon as well. SO now it is in collections and I will not pay it. Just my story.
I, too, am receiving multiple calls from this telephone number. Since there is no way that I have any accounts in collections, they are calling the wrong number. For everyone's information, it is against Federal law for debt collectors to call before 9 AM and after 9 PM. That time frame applies to the time zone Midland Credit is calling, not the time zone they are calling from. Also, they aren't supposed to call on Sundays per law. Check with your State to make sure that they are licensed to collect debts in your state, if they aren't, turn them into the appropriate state agency. Also, if they are in violation of Federal law, turn them into the feds, too Another option is to contact one of those attorney firms that go after debt collectors that violate the laws and rights of consumers. Not only does the law firm get paid by the debt collector, but the consumer who is being harrassed does, too. If the debt is a legitimate debt that the collection agency is trying to collect, you will still be responsible for paying the debt, but the collection agency normally turns the debt over to another collection agency to collect it. The money they may have to pay you for violating the law in collection practices, is paid because of their violation toward you, not proof that the debt is invalid. Collection agencies are not allowed to threaten you with arrest or with anything that is not legally permitted under Federal and state law. What they are allowed to do is tell you what your rights are and what legal steps will be taken to collect the debt (if the debt is legitimate), such as garnishing wages, civil court action, etc. One of the problems people often have is that once a debt is in the hands of a debt collector, the company that turned the debt over for collections often has turned over their original file to the collection agency, and will have no record of you or your account in their files, making it very difficult for you to resolve the issue with the company that claims you owe them money. That avenue is worth a try, particularly when you believe the collection action is being made in error.
