No reason everyone they violate can't sue them. It's not like you are suing the original company that is out of business, you would be suing this scum junk debt buyer.
Call rhe company and offer a dollar amount to settle the account. Be prepared for them to say no to your first offer. I work for a debt collectio co. Wrong. When a cust fills out an application, they sign a contract which contains a clause that advises that all information can be used to contact cust by creditor or thier assignees, in this case a debt collector. AGAIN, READ CONTRACTS BEFORE YOU SIGN THEM AND CREATE A DEBT.
JUST GOT A CALL FROM THIS NUMBER. CLAIMED TO BE CALLING REGARDING MY ETRADE ACCOUNT THAT I DO NOT HAVE. THEY WERE TRYING TO GET MY SOCIAL SECURITY NUMBER
I'm getting calls, too. Advanta got themselves into this boat by not doing what every legitimate credit card company has done for years: work with the customer. After my business ceased to exist I was left with just a pittance of the income that was allowing me to keep up with my debt. When I asked for a restructuring of the payment schedule, I was flatly denied. No one who called ever had the appropriate information (that I had supplied in writing) to be able to do the right thing. Now Carson-Smithfield is in the same boat. Who knows how long we'll all be hearing from them?!? I suspect it will just be long enough for them to sell off the debts to some other company.
