I actually work for a call center that sends out these calls. When you pick up the phone, wait about 30 seconds, and someone else will pick up the line. Then just tell them you want to be put on their DO NOT CALL list. We are required to remove your name if you ask us to. Unfortunately, these calls are completely legal because you provided your phone number when you signed up for a JCPenney card. I hope that helps!

If you call back and ask for your name to removed, as suggested by the shill for this telemarketing fraud, your number will be confirmed as live and added to a suckers list for future calls from this telemarketing fraud, and sold to the operators of similar telemarketing frauds.

I did a little detective work on this. JCP licenses use of their name and management of the card accounts to GE Capital Retail Bank (GECRB) who then sells the list to AEGON, an international insurance conglomerate that owns several US brands including Transamerica and StoneBridge.The Do Not Call Acts have a separate carve out for companies who consent to using your phone number after you give it up on the application. If you tell the caller to not call you again and they call, it is a violation of the Act. So, what I have done is sent a letter and draft small claims complaint to each party's chief executive officer with a demand letter.They either pay me or I sue them...all of them.. in small claims court. Why should the government get the fine? I was the aggrieved?
