The law most of you are quoting regarding Debt Collectors, does not apply to Creditors such as Credit cards or Car Loans. It applies to Debt Collectors only, such as Collection Agencies etc.FTC.gov - fair debt collections practices act FTC.gov for Credit Card banks is Fair Credit Billing ActHowever the Federal Communications, does have a similar law regarding phone calls at work. Go to FCC.gov, and download the Complaint form,Also before you do file a complaint with FCC.gov, they will also require you send a Written notice, to Stop Calls, at work, or on certain times / days. It's always best, to mail letter Certified Mail, so you have a receipt of when you mail and letter, and when it was received and by whom.As to Cease and Desist, again this only applies to Debt Collectors, not Original Creditors, such as on Car loans / Mortgages / Credit Cards, those are different laws entirely. You can find more information on those at ftc.gov also. I would personally never send an Original Creditor like this Santander, or a Credit Card bank a Cease and Desist Letter. Santander will simply repo your car. Santander is one of the worse Car loan finance companies, for car repos. And when I talk to Santander, b/c of the reputation on line, I always record all my calls. During one of these calls, I started to be told a different story, than was given by another employee - I advised that I recorded the call with the other employee, and I'm doing the same with them (my state only requires, 1 party be aware call is being recorded - so check your state's rules first), and Santander hung up on me!!!I am not an Attorney, but I am knowledgable in Consumer Protection Laws, fighting 3 lawsuits against us without an Attorney, and helping others, such as family members and friends only. I am not giving legal advice, just educating on what I have learned, and what I do myself, when I get calls when I shouldn't or at inconvenient times. .
I don't even have a loan with this company! The won't stop calling me. I have asked sevearl time and they continue to call!
This company bought a lot of Citi Financials loans which I had before and they have been fair with me I was a few days late here and there and they are just calling me 4-5x a day till I pay it I am just trying to get it paid off quick next time I am going through my bank and wish I had Citi Financial but you gotta make the payment and deal with that they are your auto lender but they have been very fair with me and very professional about me being a few days late so I can't complain to much but I will say one day late they are on you like flies on sh**
One payment left on a 6 year note that they bought from Citi and the called to tell me I'm 10 days late on a payment from May of 2005. WTF? The payments are on auto withdraw so if it was late it's because they didn't do it yet I show they did. They now say I need to make another payment for interest since May of 2005. What a scam.
been getting calls from them . bought a new car on 30 april and first payment isnt due til 14 May but yet they keep calling !
I have gotten repeated calls and messages from this number looking for a Roger Simmons When I called them back to tell them they had the wrong number they wanted my social security number.When I told them they had the wrong number they just kept asking for my SS# I DON'T think so
These people keep calling my house asking for my daughter which doesn't live with me anymore. I call my daughter and she tells me she's been making their payments on time.Anybody has any idea how to stop these calls?
This is the second phone call within a few weeks, I have received for Marcus James, trying to contact Kimberly James and Michael Styles, Jr. I have no idea how our phone number got associated with either of these people, I have no idea who these people are and I have asked them to not contact us again.Pamela was kind enough to notate this in the system, but stated that we might receive additional calls, as the computer may attempt to call us again, but calls should eventually stop.
As Clark Howard advises, have your daughter write them a letter, requesting not to contact any of her family members, send the letter via certified mail return receipt. Also, if she has proof she is making payments, include copies with the letter as well.Whenever I pay my bills, using a check, I make a copy of the check, before sending it and once it has cleared my bank account, I always print out a copy of the check showing it cleared my account and attach it to the bill. That way, if something were to happen, you will have proof that not only did you pay, but they also cashed the check.
