In PA the Statue of Limitations is 4 years. It does not matter how many times a debt is sold. In PA (I don't know about other states) the statue applies to the last time you paid on it. Not the last time contact was made.
The statue of limitation in California is 4 yrs. Even if debt collectors sell the debt the statue of limitation does not reset unless the debtor makes a payment in any amount since in that case the debtor is re-instating the debt. The debt is not reset just for making contact with the debtor. By the way the statue of limitation starts 30 days after the first deliquency.
Call was made to my cell. I returned the call on my land line, of course did *67 first. It's portfolio recovery, another low life collection agency that buys old, old debts for pennies on the dollar and tries to collect. Just blow them off.
Saw a call from this number that came through, no message left. Good to know about it being portfolio recovery.
Never ever talk to a debt collector... You do, and they will reset the statute of limitations, that is why they call and call and call. They want to get a recording of you saying..you owe the debt but you can't pay right now. Or you owe the debt but you're never going to pay them.. This will reset the statute of limitations. If you do talk to this Republican owned company called Portfolio Recovery, don't admit your name or that you ever owed the debt. I ignore the calls or if I'm feeling particularly ornery I'll answer and start reciting a children's rhyme, or put the handset by the tv, or I just keep saying "Helloo.. hello.. anybody there?... Hello.. hello.. until they hang up. They get really upset and it amuses me. But never ever actually talk to them or acknowledge that you're the person they are calling for and do not engage in any conversation with them at all regardless of their threats.. Another thing that gets them to hand up is to say.. Hello.. then they say who they are looking for,, they you say.. "Hold on one moment while I turn on my phone conversation recorder".. But don't lie.. They record everything and will use anything against you. People who work for debt collectors like Portfolio, Midland Credit Management, Asset Acceptance and others are low lifes and are just evil little losers who are going straight to....... well, you know.
Not really true. Just by answering the phone, or confirming your name you do not reset the SOL. You need to take personal action on the debt for this to reset (like agreeing to a payment plan, or making a payment in any amount). I would never advise that you admit to the debt either, not a good idea. In most cases, in most states, the collection agency needs to provide proof of the debt, as described by law (normally a signed contract, a signed sales receipt, or copy of a payment like an ACH record) and 99-100 times they do not have these. They will try to send a letter saying that you owe them the debt, signed by an 'officer of the company' - looks really official, but legally is worthless. I dealt with these idiots year ago, and they played this game. They even tried to file a lawsuit against me, which I encouraged. Once filed, I motioned for summary judgement on the grounds they had failed to offer proof of the debt as required, any debt they are trying to collect is beyond the statue of limitations, and I denied knowledge or responsibility for the debt. Shockingly, they took a non-suite on the case so there would be no judgement against them. About 5 years latter, they started calling again. The funny thing is, the debt they said I owed was only $1000, and they have spent 10 years now on it. Dumb.
Portfolio recovery debt collectors. get the "mr number" app and block this and any annoying number, works like a charm!!
This outfit is a collection agency who buys debts from credit card companies and they hound you for pennies on the dollar.My debt was to Capital One who was paid off when I sold my home in 2005. They admit to buying the debt that they are demanding payment for. Basically they got ripped off by Capital One! LOL........They won't go away so simply don't answer when you see a 757 number.
