Re: 828-394-0079Glad I looked this up on the net. I got a call yesterday with exactly the same--"You or your attorney call. . ." and a case number. Thanks for the posting.
I had the same type of experience with this company. After I contacted the sheriffs department and a local sheriff called they lied to him, then hung up on him. I contacted the doctor that had the original bill as well as the insurance company that will pay that bill. The doctors office said they will reimburse my $1500 but, I have contacted my attorney and we will be filing a complaint with the Attorney Generals office. My attorney said that the best way to get the business shutdown is to contact the Attorney General's office not the Better Business Bureau. If enough people file a complaint with the attorney general's office they will have to face repercussions.
GOT A FEW CALLS FROM THIS NUMBER 828-394-4403, THIS WEEK 09-23-08 / 09-26-2008 CALLER ID SAID TRINITY HOPE... ASKED FOR MY WIFE BY HER FIRST NAME SHE DOESNT USE, OR HER GUARDIAN,,,, SHE DOESNT NEED A GUARDIAN! RED FLAG!!!!! ALSO LEFT CLAIM NUMBER AND SO ON AS EVERYONE ELSE HAS STATED.... WE HAVE PAST DUE HOSPITAL BILLS IN N.C.!!!!! BEWARE I AM STILL UNSURE THIS IS NOT JUST A SCAM ARTIST...
The last name of Tonya who is harassing and lying to people, is Eggers. The person stating her name is Renee Shores is her daughter. Mother and daughter, would you believe it? They look and obviously act just alike. They have facebooks as well, if anyone cares to see their smiling faces. I have payed this company and they have yet to provide me with proof of debt, though i have requested it from three different employees, including Tonya, who by the way originally told me she was the manager and there was no one to talk to above her, but on a different day told me she was the assistant of Willa who i talked to previously and requested to speak to. Not to mention they put and extra amount on my credit report that was not actually owed, causing my score to drop. Btw, if these people are putting amounts on your credit report that you feel is not correct, then dispute it with Equifax. They will then contact Trinity who will likely not reply if its not a legit amount, and the amount will be taken of your report. If a bill is really owed, that is fine, but if you are going to request someone blindly pay you over the phone, then you should have enough professionalism to prove to them why they are paying you, that it if you are actually a professional. Now after all is said and done i will still have to investigate some things and make sure what i paid was legit, if not then i WILL NOT let this go. I hope you read that Tonya, Renee, Tabatha. Willa, Cindy, and whoever else is ignorant enough to stand with this company.
We also received a call from this 828-394-0079 number asking for my wife or our attorney to call back a Mrs. Curtis with a case number. After reading the posts here I was a very sceptical about the nature of the call.We did contact these people. They do admit to being a collection agency called Trinity Hope in Hudson, NC.When I told them that the ER physician's bill had been paid via the hospital, they insisted that it had not. I was able to get the number of the billing company,Frye Emergency Medical Associates, and found out that they were sending the bill to the wrong city. They had the correct street address, but wrong city. So, to be clear. Apparently, they are a collection agency. However, their tactics are a bit draconian especially when they tell you that you have to pay the bill today or else it will go on your credit report.
FIRST: They are Trinity Hope, reguister as a collection agency, actively bidding medical facility debt business. They are a commissioned facility. They have a vested interest in collecting, but there is MUCH you need to know about what they can and cant do.They DO violate collection laws with intimidation and threats (which are federally and civically illegal). You do have rights. They do have to adhere to and respect them. IRONICALLY, this is from their website:"With a Christian based effort to truly help our clients. Our consistent track record of uncompromising ethics instills confidence and trust."www.trinityhope.com and wwww.trinityhopenc.tripod.comPO Box 607Hudson, NC 28638828-394-4142and457 Redwood StHudson, NC 28638828-446-0710they also list in Lenoir, NCPO Box 1916Lenior, NC 28645-1916Tabatha A. Mullis828-757-0174828-757-3148 FAXTRUE: they are a collection agency earning a percentage of the bill they collect, mainly for medical facilitiesTRUE: after the bill has been forwarded to them, they have a vested interest in collecting, but not if you pay the hospital directlyKNOW THIS: The hospital WILL work with you, they have an interest in getting all or any of it paid, rather than incur collection and attorney fees. They will often reduce non-insured bills down to an insurance rate. They WILL accept $5 a month if that is all you have, and eventually, their Board of Directors will require them to write it off and after 7 years it drops off your credit. The damage is to your score.KNOW THIS: Credit and collection laws! It is ILLEGAL to intimidate, threaten, call outside a certain time of day... It is ILLEGAL for them to misrepresent themselves, misrepresent the facts or themselves, not provide written proof and documentation of the debt, not relay negotiation attempts to the debtee for them to decide accordingly.KNOW THIS: It is a CLASS H FELONY for anyone or entity to misrepresent a legal action when there is not an action filed. While the hospital may file a judgment against you in small claims court, this will NOT be done by the collection agency nor do they have the authority to do so. At some point, another company may PURCHASE the debt (like credit card cos, auto finance cos, etc), but this is rarely done by medical facilities because credit reporting laws are VERY DIFFERENT for healthcare facilities. They can report NO ADVERSE information to the credit bureaus if you are making ANY payment regularly, and or are in regular communication with them.KNOW THIS: It is advisable to deal directly with the med facility. You have a LEGAL RIGHT to require all communication occur in writing, and have no further phone calls. You have a LEGAL RIGHT to negotiate directly with the debtee and request the collection company be removed from the middle. Again, if they don't OWN the debt, they can only act on behalf of the DEBTEE if both debtor and debtee agree. You can "agree" to this indirectly by NOT communicating with the debtee.KNOW THIS: Worst Case Scenario for HEALTHCARE debt - you don't pay, over time and written attempts (one of which ahs to be certified), they file in Civil Court. The sheriff serves a CIVIL ACTION - NOT criminal - NO JAIL - gives you a date to show up in court. SHOW UP - even if you can't pay, if you make arrangements, the judge will rarely file a judgment. If the Judgment is executed - it is filed with the county, and if you own property with CLEAR EQUITY or sell your house with financial gain, earn income through a WILL, or any other transaction that occurs through the courts, tax or county offices, they will apply excesses to the judgment first - BUT ONLY IN THAT COUNTY. For some other types of debt that are sizeable, the Sheriff can sieze property and sell it at auction to apply to the debt, or garnish wages - but this is usually only for tax debt, or business siezure. Very rarely for personal debt, because of the ineffectiveness of the action. KNOW THIS: They don't have your social security number - only your account number - Don't give it to anyone ever. Privacy Laws and Hippa laws prevent the med facility from giving out that info.KNOW THIS: Pay the hospital directly - not the collection agency! Laws protect you from alot of the action and reporting of you are working with the med facility. It does not protect if the hospital is not involved in the process. The collection agency DOES NOT have to report to the hospital until the debt is collected in full or as agreed, which gives the hospital the right to persue judgment at any time. This is ceased by your cooperation with the hospital. KNOW THIS: There is a contract between the hospital and the collection agency. Some are closed: whomever collects, the hospital pays a percentage as long as the agency is in contract. Some are open: the agency can try to collect, and if they do, they can keep a percentage of it (some of which is commissioned to the collector!!), but if the hospital collects then they receive nothing. More often than not it is the latter. Two things can happen - the hospital may not advise the agency the debt is paid; the agency may not communicate with the hospital until all is collected. Both are bad. Take the commissioned collector out of the loop (which by law, you have a right to do, due to the nature of their business, are are protected from their self-interest actions). Step 1: Call them back, RECORD THE CALL, document the date and time and name - tell them that all future communication needs to be in writing and not to call your house again. IF they violate that, you can report them federally While you then may have civic action against them, what it mostly accomplishes is them losing credibility and effectiveness and court, and possibly resulting in an erased debt due to no judgment.Step 2: Call the debtee. Advise that you will be corresponding with them directly only. Start communicating. Get any reduction offers or agreements IN WRITING, and make payments, however small. Legally, medical facilities' hands are very ties when it comes to legal collection. (thank Bill Clinton for those laws)Step 3: If they continue to harrass you or call before 8 or after 8 pm, or refuse to identify themselves, you can report them to the phone company, who will then: 1) keep a running log of harrassers, and if it poses a real threat to FCC laws, will lose their service2) allow you to change your number, for free. If it happens again, they will "un"list it for free.3) allow you to block that number for free - less effective, since they often have many rollover extensions.Step 4) In this case, this company has several complaints lodged with the FCC (for phone use violations) as well as FTC complaints (for credit and collection law breaches). REPORT any breaches of your protective and privacy rights to the FTC. Any and all attention will eventually end in a legal result - they'll do their job legally, or they lose their ability to. Good luck.
So are they legally able to send letters that state if the bill isnt paid full in 10 days they can take out legal action?
Just got the call today from 828-394-4132, This time from a woman that goes by a Mrs. Kirtis, I asked it this was a business matter, she asked to give my mother the maesage that her or her attorney needed to call her back as so as possible. She said that it was a Pre Legal action and they were just trying to resolve a matter with my mom.
I received a letter from this company. They asked me to call them about a bill. I filed bankruptcy last year and have no medical bills or any other debtors. Has to be a scam. They give you no information only that you owe them money and they will accept a debit or credit card.
