dear home owner, the only way a sub contractor can not lien your home is if you can prove that Kitchen Carolina has been paid 100% for your job. If you still owe then the lien is valid and you have to go to court and prove the guy has been paid.If you have paid 100% the guy can still file the lien and you still have to go to court and prove you have paid then his fight is with Kitchen Carolina.You can also have him pay your attorney fee as well.If you owe anything and work is still not done and you have exhausted all means of trying to get the clowns to come back and finish the job "in a workmanship like manner"( do not allow them to rush through to finish just to get final payment. DO NOT SETTLE FOR CRAPPY WORKMANSHIP AND HOLD THAT LAST BIT OF MONEY UNTIL YOU ARE 100% SATISFIED) then they can fall under one of many "non compliance" statutes and you have every right to hire out and deduct what you owe from the final bill, if it becomes more then what you owe then you can sue Kitchen Carolina for the balance..good luck.The key to any construction job is documentation, documentation, documentation,pictures of bad work help in all lawsuits even if its a dog hair cut.Mr. Selfors claimed that there is over 2.4 million in receivables out there in his eyesight's which leads me to believe that lots of stuff has not been paid for 100%. This is about 400 kitchens( his words) so if you do the math each and every kitchen has a budget of 6,000 to be completed.Some will be more and some will be less but you can bet your bottom dollar that any sub doing any work that screws up in any way to blow that budget so they better take the "A" team wherever they go. To take the chance and start hiring new and cheaper guys will be the ultimate kiss off death.They have to know who the good subs are and who suck. So if you can prove that you have paid Kitchen Carolina 100% then you are safe from a lien this does not mean that the lien can't be filed it just means that you will still have to go to court and prove you owe nothing. Not fair but that is how it goes.If you have unfinished work or garbage work in your home and have tried and tried to get it done and done correctly, then hire out but have you ducks in a row with DOCUMENTATION courts love it. In the end one of two or three things are going to happen.1. The company goes insolvent and all that are owed wait in line in hopes that some how money will fall from the sky.2. They get out of this jam and continue putting in kitchens.3. A new company is formed and a new name goes on doing the same thing.Good luck to all
The Kitchen Carolina website is back up with some changes.... still offering 0% for 48 months.
Just sent letter to GE this week so no news yet. Someone mentioned that even if cabinets had been ordered but not delivered that you should be able to get out of your contract...even if you have to pay a "restocking fee". This was sugested by a GE rep to someone.The granite co. where I chose my granite said they are no longer working with KC...not sure about tile people.I hope the NCDOJ gets involved and then we will see some action hopefully.I just read that the The Kitchen Carolin website is back up.... amazing.

thanks everyone for all the great advice......I'm up for a group organization of all homeowner and contractors. We need to get the Charlotte bbb taken care of. I was assured by KC that all my $$ would be refunded even though they are having such "financial difficulty right now..... I am so hurt and feel so stupid for trusting this company.
WTF?!? Their website is back and they're selling kitchens! I just called pretending to be interested in a kitchen and this tart was ready to schedule to have someone come to my home. When I told them who I was they said my cabinets have been ordered. But of course no one knows when (read: if) my work will happen and after reading about the horror stories of unpaid subcontractors and shoddy work, I don't want this at all. As a NY native Sicilian woman...let me just tell you all...my ability to remain polite is quickly reaching its limits.
Actually my next step is calling in the State AG. All the "contact people" have disappeared, their emails are dead, their phones are just answering services. I cannot imagine making an unauthorized charge to a credit account in my name is legal.
