Filing a claim against the homeowner won't work you were contracted by kitchen carolina NOT the home owners. The subs are getting ripped but NO WHERE near as bad as the home owners. I would love to see a sub try to file suit against a home owner who got ripped, sub standard work performed, seriously inconvenienced for MONTHS and DID NOT hire the subs. Stick to cabinets because the law apparently is not your forte.....

The KC Website is obviously a temporary sham everyone. Beware. It is a sham. I have the old website page saved. They're trying to remove themselves of Legal Obligations via False Advertising. You can see their 12 Day Plan is now littered with "its a goal..." ..."things may take longer..." Pretty sneaky ....What is the point of having a twelve day plan if we usually take longer? As Linus used to say, "If you aim at nothing, you hit it every time." From the earliest dates of your project, we work toward a "Projected Completion Date", which may move, but which gives us a target to shoot for. Having installed literally hundreds of kitchens, we have found that focusing on a Projected Completion Date moves things forward when the many details of the project work to bog us down.

I feel sorry for all the subs who got ripped...I"m sorry i had no water stove refrigerator microwave sink dishwasher for 2 months!!! With a toddler and an eleven year old it has been tough. My wife and I had our attorney call them...No joy... We are filing a lawsuit against these con artists............

The homeowners paid for the "collateral" up front to kitchen Carolina not you...You are nothing but a sub contractor hired by KC to install product the homeowners already paid for... Home owners don't sweat this guy, HE is the one that needs to learn the law. i wonder if Rob's wife Cana is the one answering the phones...I can't imagine we that they have many employees left. If you click on the BBB link on their website ( YES they have a BBB reference) it takes you to the BBB site (Raleigh) that says their accreditation has been pulled and gives a link to the NCDOJ website to file complaints. Great advertising! Who the h**ll is financing them now...I heard GE Money has pulled out.

The nightmare continues - the people at Kitchen Carolina created a credit card account with my wife's maiden name and charged $8000 to it, so that's $13K they have charged to credit card accounts made out in our name without our authorization. I guess their new thing is identity theft?

The contracts stipulate a firm start date and date of substantial completion as outlined in Article 3.1 of the contracts signed by the homeowners. This is not an estimated date. This is notice to proceed and is part of the contact they have to adhere to. I intend to use this as breach of contract regardless of the status of my cabinet order (oh and they're not answering the phones now...it's only 3.30 PM). I'm just thankful I work in construction management and know enough that they can't push that date back unless I agree to it in writing which I never will.

for the innocent homeowners,each and every person that came into your home to do work has a right to file a lien against your property if they did not get paid for the work that they did even if the did a bad job. This does not mean that they will win their case. It will mean that you have to prove otherwise.You will have to get a lawyer and they will have to subpoena any and all records from Kitchen Carolina concerning your job. There will be bank records that will show if a person got paid or not. Even if Kitchen Carolina burns to the ground and all records are lost your lawyer will get the records from the bank on any checks written to the guy that put the lien on your property. Each and every check has a customer name on it so there is proof. If it can be established that no payment was made then the claim is valid. Does that mean he wins ? nope he has to prove he did the work in a "workmanship like manner" and deserves to get paid. If you had to hire outside help to get the work done and your contractor had to fix anything of the the guy that filed the lien then he has some trouble on his hands,most likely will lose the case and have to pay for your lawyer for filing a frivolous lawsuit.On the other hand if he wins you will have to pay him. If you don't then he has to sue you again to get the money and if he wins again he at least can get a judgment which will activate the lien in case of a future sale of the home.If you got a loan to do all the work the loan guys a GE will give you nothing and can not be part of the proceedings. You may if you lose sue Kitchen Carolina but good luck with that one."let the buyer beware" if you thought the deal was to good to be true then you should have done more homework ,crossed the I's and dotted the T's.Now if you did partial loan and partial cash deal and you still owe cash and your work aint done, you have every right to hire an independent contractor to finish the work and deduct that from what you owe as the final cost. Kitchen Carolina would then have to do the lien route with you. Good luck to Kitchen Carolina on that one.As far as Mr. Selfors and the Missus are concerned- they got into this with good intentions. I don't know that for sure but since I know them both I will have to say I don't think they schemed to take peoples money in the end..it just ended up that way because they didn't know what they were doing. Unfortunately for them if the cant finish anything that was paid for either by cash or loan they have a problem. If it can be shown that they took money from the company to buy nice things for themselves or took large sums of money and did not perform and went on trips and bought house and stuff then fraud takes the front seat. If they just sucked at doing business and had to get money from a customer today to finish a job 2 months behind then they could be ruined financially for life. (although I think they will find a way around that).There is a rumor of a new conference call tomorrow...cant wait.
