WV AG Sues Cavalry(Thursday, June 03, 2010) Cavalry Portfolio Sued by WV AG for Collecting Without LicenseAG Darrell McGraw Sues Four Unlicensed Collection AgenciesNY companies failed to comply with subpoena, Seattle firm added illegal feesCHARLESTON - West Virginia Attorney General Darrell McGraw's ConsumerProtection Division filed two lawsuits against four collection agenciesheadquartered in the states of Washington and New York for doing business inWest Virginia without a license and violating West Virginia consumerprotection laws.The first suit named four affiliated companies based in Hawthorne, NY:Cavalry Portfolio Services, which collects debts for its unlicensedaffiliates; and unlicensed debt-purchasing companies Cavalry Investments;Cavalry SPV; and Cavalry SPV II.That suit alleges that Cavalry Investments and Cavalry SPV I and IIpurchased an unknown number of charged-off credit card accounts and filednumerous suits in West Virginia without a license to collect the debts asrequired by state tax department regulations. The suit also alleges that theCavalry companies have refused to comply with the investigative subpoenaissued by McGraw's office."Debt purchasers like the Cavalry companies have flooded the West Virginiacourts with suits against financially unsophisticated consumers that oftenend in default judgments, garnishment of wages, and liens on homes - evenwithout actual proof of the debt," Attorney General McGraw said. "In thiscase, Cavalry has refused to become licensed as a collection agency andfailed to disclose its business activities in response to our subpoena."The second suit brought by the Attorney General McGraw's Consumer ProtectionDivision contends that Seattle Service Bureau, Inc., which does business asNational Service Bureau, of Shoreline, WA, is also unlicensed to collectdebts in West Virginia and has added illegal interest, collection fees andother charges to debts allegedly owed by West Virginia consumers. State lawsays that except for certain education loans collection agencies areprohibited from adding fees to the debts they attempt to collect."National Service Bureau has refused to cooperate with the efforts of myoffice to recoup unlawful charges and fees that it has collected from WestVirginia consumers for many years," McGraw continued. "We will continue totake any actions that are necessary to protect West Virginia consumers fromcollection agencies that refuse to abide by our laws."
This number belongs to a secondary collection agency and they will say they are a financial service, and or rebate company to try to collect. They got my cell phone number looking for a woman that past away three years ago. I have told them three times already but are still chasing someone down who is past away. Do not give them any money, if you pay a collection agency it knocks down your credit score another twenty or so points, the other thing is they have bad recall list. They also lie?
i am a teenager..there's no way i could be in any debt. does anyone know how to stop them from calling? i've never picked up, because i didn't recognize the number. they also left me messages that i could hardly hear. please tell me how to stop them
I think it's IRRITATING when people think it's "past away" instead of "passed away" too. Glad it was corrected.
Received the call on my cell phone, did not answer it as I was at work. No message was left, but I found the call itself odd for two reasons;A) The phone call came from Arizona, and I know no one from that area. I live in Canada, so that in itself was odd.B) The cell phone number is private, so I'm curious if they have some sort of auto dialer, because that information I never release.
been receiving phone calls from these guys...I also received a letter from them claiming a debt on an end of life lease with no money owed. The lease ended in 2003, I turned the car in. They are claiming I owe full value on the lease. I really think they run through your credit reports looking for old debts to see if anyone is stupid enough to pay them money. I have a lawyer chasing the claim down for me now.
