You need to contact an FDCPA atty immediatly. Below are posts from employees of Weinermen and they have now taken harrasment to an all new level. This company should be investigated and a class action should be brought against them ASAP. Some advise for you... Find an attorney and sue!!!
I received a call from Michael Oppenheimer a few weeks ago on a Thursday. He said they had sent me a letter, I didn't remember it, but agreed it was possible. He then wanted me to come up with thousands of dollars immediately. I told him I would make payments, to which he replied he would not "babysit" a payment account. He also said the banking industry needed to close past due accounts, and if we could not resolve this account now, they would have to enact collection efforts which would "not be pleasant." By the next Tuesday, I had scraped up a few thousand dollars, which they took out of my checking account, and set up a monthly withdrawal from that account. Then he informed me there would be a $5 fee for each withdrawal (charging ME for the privilege of paying them?). After calming down and reviewing what had happened, I feel like a fool that I let him take advantage of me. Also, I cannot find the letter he claims to have sent me. I have not received any printed documentation on this "agreement" for my signature. I feel this "contract" is bogus and must be canceled. I believe their tactics are unethical if not illegal, and should be stopped.
I too did a little research about this number (952-891-4555) and found this post. If it is indeed a legitimate business, then they must by law, send you the account information, and what you owe. They did this to me, also, and have yet to produce anything. I understand collections, and the attempts made to collect LEGITIMATE debts, however- if it really stinks- then the fish you smell is, well....fish!
OK, get this... the first electronic withdrawal just from my bank account just happened, and... guess what? The $5 fee Mr. Oppenheimer said would be assessed on my payment was $10! I have not yet received any printed documentation on this "contract" and more and more feel as I am wearing egg on my face. Do not let this person or agency railroad you into a quick agreement. They are not working in your best interest, regardless of what they claim.
I have had the same problem... if not worse. Sid Cohen called myself, my parent's, and my aunt (who lives 2 hours from me). He asked my aunt if not answering the phone was a family trait and asked her if I was mentaly incompetent. He told my father that my fiance (who he tried to say was me... I suddenly became a male) gave him a invalid credit card number and that I was going to go to jail for that. This was of a debt from 2004 that was PAID IN 04. Then Michael Oppenheimer decided to get in on the action, insulting me by calling me stupid and saying I was a liar... slandering my name to others.I have (and I let them know... and heads up Weinerman!... you messed with the wrong person) reported them to the BBB, as well as others. I suggest the rest of you should as well. If you need any information, just let me know and I'll help out.Oh, and Sidney and Mike? The above posts... I've documented them for my complaint against you.
They won't. That's why you smell the fish. I asked for the recordings to be played over the phone... wouldn't play them and Mr. Cohen had 50 excuses as to why they couldn't be played. Documents pertaining to the account... wouldn't send them, and again had 50 excuses as to why they couldn't be sent.
IF YOU WOULD DO YOUR HOME WORK BEFORE LASHING OUT IN DEFENCE OF YOUR LITTLE GIRLFRIEND AND ACT PROFESSIONALLY AND NOT BOUNCE CREDIT CARDS AND MISSEPRESNT YOURSELF AS YOUR GIRL FRIEND THEN THIS NEVER WOULD HAVE HAPPENED ROY,
He did not tell you that he was me. We both asked you to play the tape where you claimed he said that, and you would not. You're legally required to play the tape if I, as the person you're trying to collect the dept from, ask. You did not. He knows the laws... he is a collector as well, as he told you. As soon as he told you that, your tone automatically changed and you said that you were sorry for the things that were said. No one bounced credit cards. Try telling the facts correctly, instead of twisting them around to try and make you sound like the better person... which you are not. You resort to childish tactics to try to collect debts from people. It's immature.
He said, she said. Spammers and _______ (you can fill in the blank) have one thing in common: they lie. I found this site while looking for who's behind a number that calls and hangs up (it's a car warranty scam, not debt collection). But in reading the posts here, a few things stand out (imho): individuals from a collection agency can't even post to a web site without screaming in all caps, can't prevent themselves from calling "the enemy" denigrating words. And the post by "Joe Debtor" doesn't have a ring of truth to it, it's obviously astroturf by a collection employee.Everyone (in a one-party state) going through any type of collection attempts by someone other than the original business that incurred the debt should immediately purchase and use the necessary equipment to record incoming calls. For collection agency (and their employees) who violate federal law in debt collection, depending on the violation and the degree, you can sue them for damages. Disclaimer: always consult an attorney for advice on lawsuit and recording. A one-party state is a state that allows you to record a conversation where only one party needs to know that the recording is taking place. Check this, but for crossing state lines, if your state is one-party, then this counts for federal rules as well. For two party states, you need a recorder that beeps every (15?) seconds, and need to inform at the beginning of the conversation that the call is being recorded. While informing someone that their conversation is being recorded, from what I've been told, the collection employees are in a poor paying, high turnover job, and in their zeal to collect and earn their commission (and in their doubt that you'll ever be able to do anything with the recording), they completely gloss over the fact that they're being recorded, and can't help but revert to their denigrating and possibly slanderous language. If they are calling relatives or neighbors, if possible, try and get those conversations recorded. What they say to a third party is restricted under federal law, so its easier to nail them on those conversations. They just can't help themselves. In a one-party state, be absolutely sure that your end (neighbor, relative) is aware of the recording taking place. In a two party state, be more careful, and as before, disclaimer: consult an attorney.btw, to all the Weinerman employees apparently astroturfing here: good job. The number one search result on Google for your corporate name is this page.
I just checked the Minnesota Department of commerce website and found out that none of the peoples names that are claimed here actually work there. Richard Weinerman is the owner and apparently the only scammer in the crew willing to use his real name. Most likely because all of the other employees are too ashamed of what they do for a living. Someone should take Richard down! He runs his chop shop like a thug! I have actually had great experiences in suing agencies. I suggest that you record your calls and run to an attorney as soon as these guys call.
