Please do NOT be afraid of them. They have sued me and they may end up with a piece of paper that is worth nothing. If I were I will just protect my assets. For example, if you have a home, take a home equity loan (I guess given the current market may not be a feasible option) or simply put a family member as a lien holder. This way you will protect yourself from these [***]. They are nasty......My uncle called them and made them an offer of almost 60% of the balance.....They threaten and now am going all the way...I want them to get a judgment because I have no assets and then I want to bend before me and take a 10c for a dollar....They only believe in scaring people and taking people to courts....Do NOT be afraid of them....Just protect whatever you have and you will be fine...When the evil [***] realize they cannot collect anything, then they will be reasonable.....They are NOT going to be nice. Oh wow. A lot of negative replies for a bill collector comment page. That's original. Not biased at all.Let me make some things clear. If you are an informed citizen, (which you are likely not since you are foolish or neglectful enough to be in default of your credit agreement in the first place) then you will have learned about the FDCPA, or fair debt collection practices act. I am a collector, my colleges and I are required to learn it and follow it at all times or lose our jobs. If you catch a collector violating this act, you will most certainly be able to sue the collection company for your balance owed, if not more. It would be rare and profitable for a debtor to find a collector who leaves themselves and their agency open to this sort of lawsuit. Therefore, you ignorant people crying that the collection agency is "harassing" you should go sue them and shut up. But that is not true, because all debtors know how to do is lie. If they were honestly harassing you, you wouldn't be here, bitching.No, what they are doing is simply trying to talk to you. They want to settle a debt outside of court because it's easier for everyone for you to simply do what you signed a legal binding contract to do in the first place: pay for the [***] you bought. But you won't even talk to them because your parents, through their actions, taught you to run from your obligations. You let the phone ring, send it to voice mail, pick up the phone and slam it back down again, or simply lie right to us.Our clients made the mistake of trusting you with their money, and now you won't even talk to the people who are asking for some form of repayment. Weather that be taking payments so small it would take 100 years to pay it off, or settling the debt for 20 cents on the dollar, that's not even enough for you dead beat debtors. I wish that we could still throw you scum bags in prison like the old days. Then maybe you wouldn't live beyond your means and contribute to the stereotype fat American [***]. Looking for the easiest way out, and ignoring long term consiquences. And for those of you that claim you have some kind of rare illness or something that doesn't let you pay people back: sure, that's a legitimate excuse. However you signed the contract. You were aware of the obligation. Take responsibility and do something about it. Just talk to the collectors. They will say things that sound bad because it means changing your lifestyle. But your lifestyle is what got you in your mess in the first place.If you are talking to an experienced collector, nothing you say will make them feel compassion for you. Why? Because 100 other people use the same excuse. In the end, the client gets their money back. Weather you pay voluntarily or involuntarily, they get their money. Even if you die, its taken our of what you leave to your beneficiaries. Pay your debt. Learn how to manage credit. Take responsibility for your actions.
Blah blah, another lying debtor. Let's stop the vague "abuse" accusations. Please tell us what Zwicker and Associates did specifically that was harassment or a violation of the law.
Once again I was employed with Zwicker & Associates...Im not saying that every collector there has grace on the phone and can be easy to talk to but it is important that you get matters worked out because what the collector was telling you about the added fees is correct...If they have your acct then they have been retained by the original creditor to possibly file suit against you...So you may have to pay attry fees plus any court cost, most creditors add that stipulation in you contract but most of us never read the fine print when signing for these credit cards therefore in the end get confused when collectors start calling us. If you cant pay the balance and they are refusing to take payments from you for what you can afford the best thing to do is to call them and get their mailing address so you can send in your payments to show your willingness and intent to pay the debt in case they do try to pursue you legally...Also the acct still belongs to Amex, Zwicker is not a debt buyer they are a litigating law firm but since Amex has retain Zwicker & Associates any payment will have to be made to or through Zwicker since they are now representing Amex...If you were to contact Amex they would direct you to Zwicker...With that being said Amex is the Client of Zwicker & Associates so they are the ones that set the guidelines for payment arrangments that any case manager at Zwicker can set you up on, so it may not be Zwicker that is turning down your offer it might be Amex guidelines..You can always call and ask what the guide lines are and why they are not accepting your offered payments any case manager should be able to answer if not ask to speak to a floor manager they will be able to give you the answers you seek...Best Wishes 2 you as well
This company calls me for a Sallie Mae debt from years ago, a loan my son co-signed for his sister so that her child could go to Sylvan Learning Center for tutoring. At the time my son was doing well, had a good credit score, so he co-signed the $7,000 loan. Within months his business failed, his health failed, and his sister failed... to make any payments. Her teenage daughter attended only a few tutoring classes and then dropped out. My son called Sallie Mae and Slyvian telling them to cancel everything and that he'd make up whatever penalty charges there were. Both companies refused to close anything, or do anything. By the end of that same year the debt soared to over $12,000. Now, years later it is at over $17,000. That's when Zwicker & Associates comes into the picture. They can't contact my son, won't contact my daughter, and won't leave ME alone because my phone number was used as an emergency contact. They call several times a day and don't leave a message. They also call after 9:00PM. Tonight, for example, they called at 10:39PM. I've gotten calls at late as 11:30PM. Most annoying. Very bad business practice. I filed a complaint tonight with the FTC and will file one with my State's Attorney General tomorrow. I'm done trying to get these people to stop bugging me.
i have student loans and am still in school...i.e. my payments are defferered.....they keep on calling and now i am changing my numberthese people get paid money for this....i,e, some ons got to be a prostitute!!!
I have a question. Is there any point in filing bankruptcy if you dont have any personal assets that can be seized from you, ie. bank account, physical property etc. Other than to get the debt collectors to quit calling you is there any difference between filing for bankcruptcy and just not paying your judgemnets? I mean if you go to court and explain to the judge that you have no money in savings, no personal assests, and currently all your money is used to pay the necessary living expenses, How exactly are they goign to colllect money from you? and IF you are unemployed they can't garnish your wages. Is there a way to explain to these people that you will begin to repay your debts once your situatuion improves?
if u call the creditor theyll tell u to call zwicker..... its a lawyer hired by them to get the money back. just like u would hire a lawyer if someone broke a contract you madealso... if u want them to stop calling u dont say wrong number that will just delay it and they will KEEP calling. send them a letter saying to not contact them its a law in all 50 states that they cant contact u if you send them thatalso they only sue you if you have a job or property and the debt is pretty high... so to you SWEET guy.... all you had to do was pay or set up payments earlier now ur credit is [***] up and you probably paid a lot more then u had to lol....... dumb [***]if you think ignoring stuff is the SMART way to handle things go back to kindergarten A FOOL AND HIS GOLD ARE SOON PARTED
