All depends on your state's statute of limitation for unsecured debt. If, you were taken to court, and a judgement was issued, the collector can petition to the court to continue the judgement. In some states, the judgement is renewed every six years. If, no judgement, then most statutes of limitations range from 4 -6 yrs. Check your state rules and check the courts to make sure a judgement was not awarded to the collector; not showing up for a court appearance, enters a default judgement in the collector's (plaintiff's) favor.
I believe this is the first call I received...I don't owe anyone, anything. Next time they call they're going to het verbally destroyed...Pittsburgh style.
I informed this person that called me yesterday that I don't deal with any businesses over the phone and that I only deal with them either in person or via mail. This should have stopped the call right there but no she continued and proceeded to argue and be very rude about the situation, I informed her that it was not a good time to talk and she continued. I then asked for corporate and or mailing address and she refused, saying since I am refusing to deal with her at the moment that she would not give me any address. I finally had to hang up on her after 2 mins of her trying to overtalk me and being blantonly rude. I immediately called back the number that was on caller ID, surprise, surprise I got the same person, who proceeded to give me a different name then the last call I spoke to her on. I immediately asked for the mailing address and corporate info and she asked me my name. I told her the only thing I need and want help with now is getting a mailing address which does not require me to provide any information. She stated that she wouldn't give me any information without my name. I had advised her that I am familiar with the laws concerning debt collection companies and that they are required by law to provide such information when it is asked for. She stated it didn't matter that she wasn't going to give it to me. I hung up and called back, hoping I would get a different person on the other line, but when it was the same person, yet with a different name, I immediately asked for a supervisor. She proceeded to try to argue that there was no such thing as supervisors there and that she was an Account Manager. I proceeded to let her know that I am also in the call center field and know that her title is just a fancy name for a collection agent and that I needed to speak to a sup ASAP due to a complaint I will be filing with the FTC. She got a supervisor on the line and that person also refused to provide me wih the address. I informed her that its ok I can I online but I was wanting to see if you would give it as required by law. She said "Well, why don't you get it online and quit calling here" Seriously? They blantonly are breaking so many laws it is not even funny. Time to file a complaint.
Portfolio Recovery - debt collector. Weird thing was they were collecting for US Cellular, of which I have never had service with. They had my Sprint phone number, my maiden name (I've been married 5 years), an address I have never lived at and the last 4 digits of the SSN were not mine. I thought that was strange.
Got a call from them last night saying they had an old debt I owed JCPenney. Have never HAD a JC card! Scary part, they had the last 4 digits of my SSN which I would not confirm.
They are [***] . Ignore them and don,t answer their calls. I think it hurts their feewings
A family member received a bill for back taxes from the IRS based on PRA's charge-off of this debt which had long since been disputed. We immediately disputed both claims, submitting copies of the original DV letter and corresspondence mailed to and received from the FTC and our State's AG office. The IRS wrote back, stating they had requested "additional documentation" from PRA which was due within 60 days and would render a decision when it was received.PRA hung themselves. They never responded to the IRS's request for documents and DEFAULTED. As a result, the 1099-C was invalidated and the tax matter closed.My guess is that PRA never had the documentation to support the 1099-C they submitted to the IRS to BEGIN with. One can only wonder just HOW many of these they are sending to the IRS....**IF YOU RECEIVE A 1099-C AT TAX TIME ON A TIME-BARRED, DISPUTED AND UNVALIDATED DEBT FROM PRA, REPORT IT TO THE IRS IMMEDIATELY!!**
just wait until they call you a dozen times in a day (which they do, i know) then get a copy of your phone calls showing all of them listed....send a nice certified/return receipt requested letter saying they are HARASSING you which is a violation of the FDCPA and that they now owe you $1000.That usually gets them to shut up.
You can look up what others say an know who it is. I don't answer or call back once I look up the number I block them.
