The FDCPA applies to third party debt collectors. This means a company hired by the company who is actually owed the money to begin with. ACE is the company to whom you actually owe the money, therefore the FDCPA does not apply. Your best bet would be to work with them, not against them. Get the debt paid, and if you choose not to do business with them again, so be it. They don't know what kind of situation you're in if you don't speak with them calmly & rationally. And the center employees are trained never to refuse a payment, fyi.
I saw today that today that in an effort to improve customer service relations, that ACE is giving 30 percent off any loan if you call Mr. Huson at 972 550 5000 #7721 and verbally submit "a great Ace experience". All you have to do is simply tell him (or leave a voic mail) about a good experince you had at an ACE location, and they will knock 30% off your loan if it's legit!!! For what it's worth, I'm hearing this offer ends January 30th.
ACE has called me numerous times. They said that Tony, (an old friend of mine) used me as a reference, and has defaulted on a loan. I've told them several times that Tony moved to California last summer, and I have not heard from him since. Then the caller gets angry and says that I need to find Tony and make him call them back. Are these people crazy? Why should I look for him?I think I found a solution though. The last time they called and were rude to me, I asked them to "hold on". I put the phone down, and went out to lunch. When I got back, they had hung up. I wonder how long they waited before they gave up? Funny...I haven't received another call.I don't suggest doing this if you owe them money, but if they are calling you for someone else's debt, try it. It worked for me.
called looking for someone else. failed to identify the purpose of their call & why they were calling. This is not legally according to your privacy rights under the Fair Play and the Fair Debt Collection Practices Act.
ACE does first party collections...and if you were in collections you would not it is not the "Miranda Rights" that is what the police read you..it is called the Mini Miranda..and it is only reaquired by THIRD party collectors.
I would be careful if I were some of you. I thought the same thing..there is nothing they can do if I don't pay it. Then I lost my driver's license..and when I went to the DPS to get a new one..I was arrested because of a warrant for theft by check..which after I found out was going on turned out to be due to the check that I gave to ACE to secure a payday loan.Just letting everyone know.
The FDCPA clearly states that when contacting third parties, a collector may NOT disclose the purpose of his/her call, and may ONLY disclose from where he/she is calling if directly asked. However, as previously stated, ACE Cash Express is NOT a third party collection company, therefore the FDCPA does not apply.
I received a similar call for an account that was missed while on a busines trip. Mr. Paul Mullard advised that my case would be filed and so and so on when the actual contract reads arbitration which is a sit down. No courts are involved and they are simplying trying to set in fear. I would advise them not to call place of employment as they must adhere if you request so and file with the BBB.
