Good write up. The first time a company passes debt to a collection agency it is usually on contingency basis. The collector usually keeps at least 30%. When the debt is really old then the file is sold for a few cents on the dollar.You are right on the money and don't let them get the best of you as it's fun for them.These people act like they are lawyers, when in fact they hire an attorney if they sue.

Gee Kate that is great, you are a wonderful person and did a great job...by the way when you planned for that rainy day did you plan to lose your job for a year and a half, struggle to keep food on the table for a family of 4 while keeping all of your bills current? Were you too experienced in YOUR job that potential employers would not hire you because they knew they could not afford your salary (even though you specifically said you will work for half?) I doubt it...you had to have some kind of steady income while doing what you did, some are not as fortunate and the jobs they had for many years disappear because of the economy and no fault of their own. They are not able to find work that even comes close to paying the salary they had made for many years. It does not take long for you to get behind even if you planned for that rainy day when you suddenly have no income.

Good point Josh. I don't think most people understand that the reason these so-called collection law firms have such good track records in court is because the defendants never show up. I once disputed a debt and requested validation and the collector responded with a 1 paragraph type-written statement, that looked like it was made in Windows Notepad, that stated they had purchased the debt from such-and-such a company and it was valid. Literally, "valid," as if that made it so. I laugh when I imagine the kind of "proof" these collection attorneys are actually walking into court with and would have to show the judge if debtors actually showed up to defend themselves.

So what you are saying is, it really doesn't matter what the creditor does, (in some cases the creditor does illegal things to lock you into paying much more than you originally agree to, or have a payment due on sunday that they recieve on saturday yet charge you late fees because they can;t process it until monday, or flat out change your account from a fixed rate to a variable rate) you are responsible and a deadbeat for not just paying it? All of the above are illegal, and they should not be able to do it, yet they do over and over than hire firms like Zwicker to collect when the debtor fails to pay. Most people can't afford attorneys to fight a credit company that has millions of dollars and law firms on retainer, and if they don't, they get money from the government to take care of their mismanagement of funds (just because all of their debtors don't pay them does not give credit companies the right to not pay their bills either, yet they did....and taxpayers bailed them out, they did the same thing the people they are going after did.) You are not trying to collect to pay the original creditor...you are a liar. Your firm (or the collection agency it works for) has bought the debt for pennies on the dollar, the credit company charged off the debt (in most cases) that is why you don't introduce yourselves as from the original creditor but as an employee of a collection agency and not an employee of (blank) bank or credit card company, furthermore we could not go to the orginal creditor and negotiate a payoff, they will refuse to talk to debtor and refer them to the collection agency, . We are not fools, nor did most take on the debt with the intention of defaulting...sometimes it is the change in the creditors policy or an amendment to the agreement that causes the default. Other times it is a late payment that prompts credit agencies to raise interest rates to an out of control amount. It should be illegal and there is legislation now making it such, but do not think that any of that gives you the "right" to pass judgement on the people you are calling, try listening to the reason there was a default maybe you will gain some insight as to what is going on. Maybe you will change your mand about the "deadbeats" you are going after and realize that there are usually good reasons why someone fails, not always that people just want something for free.

up until last week i hadn't received any calls from these people. they would call before and leave messages stating that by remaining on the line i am acknowledging that i am the person they are calling for... i listened out of curiosity... they started sending me these letters on blue paper that said that said they are notifing me of their intent to deposit MY post-dated check...this is interesting because i never gave them a post dated check let alone done business with their client, The Education Resource Institute, INC (TERI). I looked this "TERI" up and found that they have filed chapter 11 bankruptcy... now i have some school loans, but those are being paid for with other arrangements. ive never done business with TERI.... oh yeah, a couple of times they've sent letters stating they are going to submit their ACH payment to my acct as well...has yet to happen...wtf?!

I have tried to work with Discover on a hardship program which they gave me for 1 yr. I calledand asked them to continue but the refused. I am now working with Everst Debt Solutionsand I understand the process they have me go through(this by the way is my Mom's Debt butshe now has dementchia and I have poa). If this all works out this debt of just over 18,000can be paid in 3 yrs. I did get a letter though from Zwicker attempting to collect the debtand have as of today refered them to Everest. My concerns are if they sue do I need anattorney?? We just can't afford one. My mothers owns nothing and her SS is very limited.I worry they would come after me the poa and take my home or garnish my ss which isvery very low. This all is making me crazy.I want to continue with Everest as I dotrust them and this was my only option.
