You need to lookup the FDCPA. A collection agency can't tell you all that. There are federal laws they have to go by. Call them back but record the call, then give the recording to any lawyer in the world. You could win big.
I received my first phone call from Credit Smart, LLC in April 2010. I questioned the legitamacy of this debt immediately. I asked for information such as, the progression of the supposed debt, specific dates of transfer from one creditor to another, the accrual of finance charges... and they could not (and will not) provide me with any of this information. They mention that it is ruining my credit--- well, I pay monthly to monitor my credit via the 3 main bureaus and not one of them had information on it pertaining to this debt with Credit Smart. According to Credit Smart this $400 debt was from 2001 which far exceeds my state's (Minnesota) statute of limitation (6yrs). I have visited their website and everything on it is superficial. Stock photos, exaggerated and falsified praise from customers... and I tried on many occassions to email them with the link on their website, but never once did it go through. Continued to get kickbacks stating that the account was not valid. Names they have used with me are: Sarah Levy, John Stevenson, Jenny Lopez = all fake.
Well the pre-recorded message that had my Full Name inserted in it said they were calling me about a Tax-Relief program I qualified for. Since this number is well known here for debt collection, it is obviously a full out scam. I had one old card debt that I am actually paying off through a lawyer. But before that the info got passed around so much that I have had 4 different collectors each claiming to 'own' the debt at the same time. When I told them they would have to present the Original Signed agreement, they would either ignore me, or try collecting again under another name. Since my card is being paid off with a known established law firm, these are all scams. Once the bank releases your information, any number of people can get a hold of it and claim (falsely) that they own it. If they will not show up in court to present the original signed agreement (no photocopies), then they do not own the debt, they simply have information that it once existed.
Called again, and again pre-recorded message with my full name inserted claiming I have been pre-approved for tax relief program. Called my cell phone which is on national no-call directory.
Just got a call from these people on my cell phone - left no message.Then got a call on my home phone. Message said I was "approved for hardship settlement with Credit Smart" and to call the (877) number with my approval code to begin my settlement. Funny. Nothing appears on my credit report.I believe these same people have called before. My caller ID stated it was a Virginia number but the message left said they were from a New York office and that they "needed to talk to me about a pre-trial legal matter". The Virginia number on my caller ID happened from a town where my mother-in-law works.........for a STATE JUDGE!! Gave her a call, she said it was totally bogus. One state cannot claim a legal proceeding in another state.Un-F*ing-believable.
Scam debt collector. Called my parents house which I havent lived out since I was 18 yrs old (12+ yrs ago.) Told my parents they were turning my case over to the county sheriffs dept. that day if I didnt call and pay to have it stopped. When my mother said I didnt live at that # they said "Well, dont you want to give her the message, this is an important matter, and legal action will be taken!" Knowing I have not had bad debt since I was 18, I looked up the # and found out IT IS A SCAM! They take your very past (8+ yr) bad debt to try to get $ from you. They have no proof of the debt you owe and it would cost them more $ in legal fees to come after you than it is worth. The debt they are trying to come after me for is less than $500. So I say, go ahead Credit Smart, spend thousands of $'s to take me to court for a debt that is long gone. FYI: Just to be safe, make sure to get your credit score after getting these phone calls. IF, there is something on there from Credit Smart- contact them damanding proof and demanding that the info is taken off. These guys are very scummy, who knows what they are doing along with these fake phone calls.
I also got a call from this number. Interesting when I informed the person that was on the other end that this was my cellular phone and I am listed on the do not call registry she then proclaimed that she is not selling anything so it is legal. I asked for her name and the company name she simply said her name was Lisa. And if I wanted to know any more I had to call this number immediately to find out about a very serious pre-legal matter. It is a New York Number, and they just answer the phone "Hello" or "Who am I speaking with" interesting. I reputable company would answer the phone. "Good morning, thank you for calling XYZ, how may I assist you" they are just rude, and New York Rude to boot. I pulled my credit and yup still at a 725, not one collection on there. He claimed there was something for $235 ordered from home shopping network 9 years ago. I have never ordered anything from home shopping network. What ever happened to due process. I consulted a friend of mine, who is an attorny, and asked his advise. They are using a scare tatic. They call it a pre-legal matter. They pull your credit report and then they have your addresses. They bought this debt, if there is one for pennies on the dollar. So I am being harrassed by somone that paid 25 cents to harrass me, and he gets a commission for getting me to pay the bill. He said they will also seek you out on Facebook, Myspace, Twiter and email and call all of your friends. They are just a cockroach that thinks if they push hard enough you will just pay the bill. Legally if there is a debt, they must provide you with documentation in writing. Then if you read the fine print you have 30 days to dispute the validity of this claim or the claim will come valid. So they send you a letter, if you do nothing then it goes on your credit. If you dispute the claim, within the 30 days, they must provide proof that you where the person that made the purchase. Much like a credit card dispute. I told the "COCKROACH" on the phone that I wanted him to seld the paperwork, and he got all testie with me and said why dont we just settle it now. Block the number, and then if they continue the calls report them. This is truely a reportable company.
Scam operation. trying to collect on old charged off unenforceable debts! No court in the U.S. will uphold these clowns! They buy old debts from years ago and try to get idiots to pay them for nothing but a stupid scam! Don't fall for these idiots and the stupidity of "reselling old charged off ancient debts"! The government needs to shut these marginal "bottom feeders" down and end this garbage practice!
