I have a loan with sallie Mae unfortunately, And I have an account with Zwicker and associates.I am thinking about filing bankruptcy. Sallie Mae said they can not be discharged. I don't think so.Let me know who do I contact for the class action law suit.sheldon
You are an idiot. The lawyers suck and are afraid of any trial because they know that a witness for their client probably wont show up. Send a cease and desist letter to stop the calls. File an answer and notice a witness for trial. Odds are, your case will be dismissed.
It is a private student loan and can be discharged. If it is a government back student loan then it can not.I have an attorneys appoint ment, This is what I have read. I will make clarification.
They use fake names. Tell them you wont speak on a recorded line and hang up. Send a cease and desist letter to stop the phone calls. Answer the complaint (if you are really served with it, they make up fake service all the time so if you get a weird notice from the court, get an attorney, go to legal aid, get help). Then they dont have witnesses for most of their trials because the creditors are overwhelmed. Get advice and notice a witness to trial. They'll probably dismiss. Never agree to an extension to any discovery (questions) or trial with their attorneys. Its a slop shop.

What seems to be missing here is that they are acting as lawyers and some may be lawyers. I say report them to the bar. The only thing a lawyer worries about is the BAR. You should still complain to the FEDs but the bar is the key and when asked it is for unethical practices. Stand up for your rights and do not let them get away with this. They are breaking the law as well as ethical rules. Report Zwicker and Associates to the bar and you will see a change.
I have been with a company for two years working on getting everyone paid. Now Zwicker & [***]. has sent a "summons" to appear. I got it a month after it was dated. No court seal, no clerk signature. What do I do to fight this? My consolidation company doesn't want to help me any further on this one.
